Terms of Service

1. Who may hold an account

The Service is a creative storytelling tool designed for children to use under adult supervision, but accounts belong to adults. You may create an account only if you are at least 18 years old and have the legal capacity to enter into these Terms.

By creating an account you represent and warrant that: (a) you are 18 years of age or older; (b) you are the parent or legal guardian of, or have the verifiable consent of the parent or legal guardian of, every child who uses the Service through your account; and (c) the information you provide at registration is accurate.

Children may use the Service only through kid profiles inside a parent-held account and may not register their own accounts. You are responsible for all activity that occurs under your account, including activity by children you permit to use it.

2. The Service

Tellasaurus lets children and families brainstorm characters, places, and stories with an AI assistant, and generates illustrated storybooks, character art, world maps, and read-aloud narration from those ideas using third-party artificial-intelligence models.

We may add, modify, or discontinue features at any time. We will make reasonable efforts to notify you of material changes that reduce the Service's core functionality.

3. AI-generated content

Stories, images, maps, and audio produced by the Service are generated by artificial-intelligence models. AI output is probabilistic: despite the safety measures described in Section 4, it may occasionally be inaccurate, of low quality, or different from what you or your child expected, and on rare occasions may include content you consider unsuitable.

We encourage parents to review generated content with their children. If you encounter content you believe violates our content standards, contact us at support@tellasaurus.com and we will review it.

As between you and Tellasaurus, and subject to these Terms and the rights of the underlying model providers, you own the stories and artwork generated in your account for personal, non-commercial use. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely as needed to operate and improve the Service (for example, rendering your books, generating narration, and serving share links you create).

4. Content standards and safety

The Service applies layered safety measures designed for children aged 3–12, including age-scaled content policies in our AI prompts and safety filters on our image-generation provider. These measures are designed to prevent graphic violence, sexual content, hate, and other material inappropriate for children, while still allowing age-appropriate adventure (for older reading levels, that includes villains, peril, and stylized storybook battles).

No automated safety system is perfect. The Service is provided for supervised creative play, and parents remain responsible for supervising their children's use of the Service and reviewing generated content.

You agree not to use the Service to attempt to generate content that sexualizes minors, depicts graphic violence, promotes self-harm, harasses any person, or violates any law; not to attempt to bypass or probe our safety systems; and not to upload photographs of any person without that person's consent (or, for a child, the consent of the child's parent or legal guardian).

5. Your content and uploads

You (and children using your account) may provide content to the Service, including chat messages, story ideas, and uploaded photos ('Your Content'). You retain ownership of Your Content.

You grant us a license to use Your Content solely to operate the Service — including transmitting it to the third-party AI providers that power generation (see the Privacy Policy for the list) and storing it so your world, characters, and books persist.

You represent that you have all rights necessary to grant this license, including consent from the parent or guardian of any child appearing in an uploaded photo.

6. Credits, subscriptions, and billing

Some features consume credits, which can be granted at signup, purchased in packs, or included with a subscription. Payments are processed by Stripe; we do not store your full payment-card details.

Credits have no cash value, are not transferable, and are consumed when generation begins. If a story generation fails entirely, the credits for it are automatically refunded to your balance; a partially completed book (some pages generated) retains its charge.

Subscriptions renew automatically until canceled. You may cancel at any time, effective at the end of the current billing period. Except where required by law, purchases are non-refundable.

7. Privacy and children's privacy

Our collection and use of personal information — including the limited information collected from children with parental consent — is described in the Privacy Policy and the Children's Privacy Notice. By accepting these Terms and checking the parent/guardian attestation at signup, you consent to your child's use of the Service as described there.

8. Intellectual property

The Service — including its software, design, mascot, brand, and all content we provide (other than Your Content and your generated stories) — is owned by Tellasaurus or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

9. Termination

You may stop using the Service and delete your account at any time from account settings.

We may suspend or terminate your access if you materially breach these Terms, misuse the Service, attempt to bypass safety measures, or where required by law. Where practicable, we will notify you and give you an opportunity to export your stories.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS OR BE FREE OF MATERIAL YOU CONSIDER UNSUITABLE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELLASAURUS AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) FIFTY U.S. DOLLARS (US$50).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Tellasaurus and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from: (a) Your Content, including uploaded photos; (b) your breach of these Terms, including the parent/guardian representations in Section 1; or (c) your violation of any law or the rights of any third party.

13. Governing law and disputes

These Terms, and any dispute arising from them or from your use of the Service, are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules.

If you have a concern, contact us first at support@tellasaurus.com — most issues can be resolved informally, and we will work with you in good faith to do so. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Colorado, and each party consents to their jurisdiction. Nothing in this section limits any right you may have under the consumer-protection laws of your place of residence.

14. Changes to these Terms

We may update these Terms from time to time. Each version is identified by its version date, and your account records the version you accepted. If we make material changes, we will notify account holders (for example by email or an in-app notice) and may require re-acceptance before continued use. Continued use of the Service after the effective date of an updated version constitutes acceptance.
